POLICY AND TERMS OF USE
Before you click on the SUBMIT button in the submission page, make
sure you read all the conditions and terms of the agreement carefully. By
clicking the SUBMIT button you are agreeing to be bound by this contract
with respect to all work that has been submitted in the past, present and
future. If you do not agree with all the terms that are outlined in this
document then do not upload any of the material on the MYOCAD site.
Introduction
This is a brief overview of all the terms and conditions that you will be bound
by when clicking on the SUBMIT button and uploading materials on MYOCAD. By submitting
photographic, artistic, computer-generated and/or other materials (audio, visual,
audiovisual and otherwise) to us you are agreeing to the terms and conditions
outlined in the following contract .
1. You are giving us the
nonexclusive rights to include your materials in our database which we
make freely available over the World Wide Web.
2.You are also claiming
to us that you have the right to allow us to so use the materials that
is being uploaded and are agreeing that in case of a legal dispute, to
cover the costs of our defense if someone claims that we do not have the
right to use the materials or that you do not have the right to allow
us to so use the materials.
3. Our right to use your
materials in this manner outlined will continue until you choose to remove
your materials in part or in whole from our website. Any removal of material
must be made aware to us in writing that you want to terminate this agreement.
4.You are also agreeing
that we are not in anyway responsible for your work while it is on our
website. This includes protecting it from other people, and that we are
not responsible for its removal from our website. If someone steals the
uploaded material in whole or in part, we are not responsible for this
action and you must pursue the individual and not MYOCAD.
5.We also claim the right
to without notice or reason to remove any material uploaded.
6. By uploading your material,
you are agreeing that we have permission to use your name and likeness
on our websites only in connection with the promotion and marketing of
our business. Until you notify us that you wish to terminate this agreement
and you have removed all of your materials from our website we can refer
to you as a member of MYOCAD.
7. If we have sublicensed
your materials to another website, and you disagree with this action it
is your responsibility to have your materials removed from that website.
We will not be held responsible or liable if the other website refuses
to remove your materials.
8. We reserve the right
to make changes to this agreement in the future, but any changes would
not apply to you unless you accept those changed terms.
